These terms apply when you use the Casual Development website or engage us to design, build or maintain a website. "We", "us" and "our" mean Casual Development (Yossef Taha), based in Ireland. "You" means the client or site visitor. By using our site or accepting a quote, you agree to these terms. If we sign a separate written agreement for a project, that agreement takes priority where it differs from these terms.
We design and build custom websites and online stores, and we offer optional ongoing hosting, maintenance and support. The exact scope of any project is what we agree with you in writing (by email or proposal) before work begins.
We may build a demo of your site before you pay anything. The demo is provided so you can decide whether to proceed. It carries no obligation to buy, and ownership of the demo and its code remains with us until the project is agreed and paid for. If you do not proceed, you may not use, copy or publish the demo.
Timelines are estimates and depend on you providing what we need and giving timely feedback. Revisions included in your plan are described in the quote. Work beyond the agreed scope may be quoted separately.
Where we set up hosting or a domain for you, they are yours to keep. Optional care plans (maintenance, updates, backups and small edits) are billed monthly, require no long-term contract, and can be cancelled at any time. If a care plan ends, ongoing updates and support stop, but your site remains yours.
Because we show you a free demo first, there is nothing to pay unless you choose to proceed. If you cancel after work has been agreed and started, any work already completed is payable. Amounts already paid for completed work are non-refundable.
We build your site with reasonable skill and care. Beyond what we expressly agree, the site and our services are provided "as is". We do not guarantee specific search-engine rankings, traffic, sales or third-party service availability. You are responsible for the content you publish and for complying with laws that apply to your business.
To the fullest extent permitted by law, our total liability arising out of or in connection with a project is limited to the fees you paid us for that project. We are not liable for indirect or consequential losses, or for loss of profit, revenue, data or goodwill. Nothing in these terms limits liability that cannot be limited by law.
Each side will keep the other's non-public information confidential and use it only to carry out the project.
Either side may end a project if the other seriously breaches these terms and does not fix it within a reasonable time. On termination, you pay for work completed up to that point, and each side returns or deletes the other's confidential materials on request.
These terms are governed by the laws of Ireland, and the courts of Ireland have exclusive jurisdiction over any dispute.
We may update these terms from time to time. The version in force is the one published here on the date you accept a quote or use the site.
